1. Acceptance of Terms
By accessing and using PULMUR® Coffee's services, website, or placing orders, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and PULMUR® Coffee, a brand of Ephesus Global Trading Sdn. Bhd., registered in Malaysia.
2. Business-to-Business Services
PULMUR® Coffee provides business-to-business (B2B) coffee supply services exclusively to commercial entities including cafés, hotels, restaurants, corporate offices, and other business establishments. Our services are not intended for individual consumer purchases.
3. Product Information and Orders
- All product descriptions, specifications, and pricing are provided in good faith but may be subject to change without notice.
- Orders are subject to acceptance and availability. We reserve the right to decline or cancel orders at our discretion.
- Minimum order quantities (MOQs) may apply to certain products and services.
- Custom blend development requires separate agreements and may have extended lead times.
4. Pricing and Payment
- All prices are quoted in Malaysian Ringgit (MYR) unless otherwise specified.
- Prices exclude applicable taxes, duties, and delivery charges unless explicitly stated.
- Payment terms are typically 30 days from invoice date, unless alternative arrangements are agreed upon in writing.
- Late payment may incur additional charges as permitted by Malaysian law.
- We reserve the right to require payment in advance or provide alternative payment terms based on credit assessment.
5. Delivery and Risk Transfer
- Delivery timeframes are estimates and may vary due to factors beyond our control.
- Risk of loss transfers to the buyer upon delivery to the designated location.
- Delivery scheduling is subject to roast schedules and availability.
- Force majeure events may affect delivery commitments without liability to PULMUR® Coffee.
6. Quality Assurance and Returns
- We maintain strict quality control standards for all coffee products.
- Defective products must be reported within 7 days of receipt for consideration of replacement or credit.
- Returns of non-defective products are generally not accepted due to the perishable nature of coffee.
- Quality disputes will be resolved in accordance with industry standards and Malaysian commercial law.
7. Intellectual Property
All trademarks, trade names, logos, and proprietary information related to PULMUR® Coffee and our products remain our exclusive property. Customers may not use our intellectual property without explicit written consent.
8. Limitation of Liability
To the maximum extent permitted by Malaysian law, PULMUR® Coffee's liability for any claims arising from these Terms or our services shall not exceed the total amount paid by the customer for the specific products or services giving rise to the claim. We shall not be liable for indirect, consequential, or punitive damages.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of Malaysia. Any disputes arising from these Terms or our business relationship shall be subject to the exclusive jurisdiction of the Malaysian courts.
